On May 12, 1999, the Miami office of the Equal Employment Opportunity Commission filed a lawsuit under Title VII against the Asplundh Tree Expert Company in the U.S. District Court for the Northern District of Florida. The EEOC alleged that the defendants had violated the rights of the complainant by subjecting him to a hostile work environment, wherein he was harassed on account of his race. Since we have only the docket and the district court opinion in this case, we have no further information on the complaint.

On February 16, 2001, the parties filed cross motions for summary judgment. On February 20, 2002, the district court granted summary judgment to the defendants and dismissed the complaint, finding that the plaintiffs had not satisfied the conciliation requirements of Title VII. E.E.O.C. v. Asplundh Tree Expert Co., 2002 WL 500935 (N.D.Fla. 2002).
