In September 2004 the New York district office of the EEOC brought this suit against Champlain Valley Physicians Hospital Medical Center in the U.S. District Court for the Northern District of New York. In its complaint, the EEOC alleged on behalf of two charging parties that the defendant violated the Americans with Disabilities Act (ADA). Specifically, the Commission alleged that the defendant failed to provide the employees with reasonable accommodations and maintained a policy prohibiting disabled employees from returning to work.

The case was resolved by the entry of a consent decree in September 2004. In the three-year consent decree, the defendant was required to provide the disabled employees with reasonable accommodation, if necessary, and to comply fully with the ADA. The two charging parties were awarded $55,000.00, and the defendant was required to provide EEO training to its employees.
