In February 2002, the Tampa Area Office of the EEOC filed this lawsuit against Norstan Apparel Shops, Inc., doing business as Fashion Cents, in the U.S. District Court for the Middle District of Florida alleging discrimination on the basis of sex, female, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant retaliated against the plaintiff, a newly-hired female store manager, by firing her after she complained to store management on …

In February 2002, the Tampa Area Office of the EEOC filed this lawsuit against Norstan Apparel Shops, Inc., doing business as Fashion Cents, in the U.S. District Court for the Middle District of Florida alleging discrimination on the basis of sex, female, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant retaliated against the plaintiff, a newly-hired female store manager, by firing her after she complained to store management on behalf of female employees about alleged sexual harassment in the store. The plaintiff intervened in the lawsuit in July 2001. Following extensive discovery, a partially successful motion for summary judgment by the defendant in July 2002, and a referral to mediation, the parties settled the lawsuit in September 2002 through a consent decree.

The three year decree required the defendant to: make compliance reports to the EEOC, retain records regarding complaints of retaliation for monitoring by the EEOC, expunge the complainant's employment record, agree not to discriminate or retaliate, post and distribute notice of employee rights, provide managers and supervisors with annual training, and pay the complainant $250,000 in backpay and emotional distress.
