The EEOC's Los Angeles district office filed suit against Lawry's Restaurants, dba Lawry's The Prime Rib, Five Crowns and Tam O'Shanter Inn, on March 31, 2006 in the U.S. District Court for the Central District of California. The docket is the only available document for this case and it is uncertain what the EEOC claimed as causes of action. Lawry's Restaurants, Inc. filed a motion for summary judgment in November 2006, which was granted in part on January 26, 2007 such that the class the EEOC purported to represent would be limited to those individuals the EEOC could show 1) had an interest in being a server and were denied or refrained from applying during the statutory filing period, 2) the class of people the EEOC could collect back pay for two years, and 3) were from the class of people that the EEOC could collect compensatory and punitive damages.
