Case Summary

The Chicago office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois, against Hinsdale Hospital. The complaint filed in June 1998 alleged discrimination under Title I of the Americans with Disabilities Act ("ADA"). Specifically, the complaint alleged that Defendant discriminated on the basis of a disability by maintaining an insurance benefit plan that denied coverage for prosthesis-related treatment, and that such discrimination resulted in the charging party's constructive discharge. Defendant moved for summary judgment on the grounds that the plan provision on which the plaintiff relied was not a form of disability based discrimination prohibited by the ADA.

The United States District Court, N.D. Illinois, Eastern Division, granted Defendant's motion for summary judgment in June 1999. The unpublished opinion was handed down June 30, 1999. F.Supp.2d, WL495480 (N.D.Ill.), 16 NDLR P 35.
