Case Summary

In January 2000, the Charlotte Office of the EEOC filed this lawsuit against Graves Environmental (doing business as Graves Environmental and Geotechnical Services Incorporated), Graves Construction Services Inc., Graves Water Services Inc., Graves Drilling Services, and Graves Engineering Services Inc. in the U.S. District Court for the District of South Carolina alleging discrimination on the basis of gender, female, in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. Following discovery and a motion for summary judgment granted in part for the defendant, motions for summary judgment by the EEOC and complainants that were denied, several motions to dismiss by the defendant that were denied, and a motion to dismiss due to the willful dishonesty of a complaining party that was partially granted, the parties settled the lawsuit in July 2002 through a consent decree.

The three-year decree, containing anti-discrimination and retaliation clauses, required the defendants to: report complaints and make other compliance reports, allow the EEOC access for monitoring, expunge the complainants' employment record, develop an anti-discrimination policy, post and distribute notice of EE laws, provide EEO training, pay the complaining parties $52,500 and waive payment of fees and costs taxed against the complainants by the court amounting to an estimated $3,500.
