The lawsuit was filed in the United States District Court for the Southern District of Texas (Galveston) on 09/23/1999. The five individual complainants did not intervene in the suit or file a separate suit.

Defendant moved for summary judgment after the trial date for the case was postponed. Before the district court made any decision, the parties settled and the case was administratively closed. A consent decree was entered by the court on 04/26/2001.

Under the 18-month consent decree, the defendant agreed to pay the five individual complainants a confidential sum. The defendant also agreed to hire two complainants, and not to rehire the individual engaged in discrimination. The consent decree also required the defendant to revise its EEO policies, provide training and post notice of EEO policy.
