In September 2002 the Philadelphia office of the EEOC brought this Title VII suit against Muhlenberg College in the U.S. District for the Eastern District of Pennsylvania. The complaint alleged that the defendant discriminated against the claimant by denying the claimant tenure because of his national origin (Chinese). The court granted the defendant's motion for summary judgment in April 2004, holding that the defendant denied the claimant tenure because of legitimate non-discriminatory reasons. The EEOC filed an appeal in June 2004, and the Third Circuit affirmed the decision of the district court in May 2005. See EEOC v. Muhlenberg College, 131 F. App'x. 807 (3d Cir. 2005).
