The complainant brought a separate suit against the defendants in May 2005. The complaints are unavailable so the allegations are unknown. The cases were consolidated in August 2005 and the EEOC case was designated the lead case. Little litigation activity occurred until the case was voluntarily dismissed in October 2006, with attorney's fees being awarded to the defendant against the private plaintiff.
