In September 2002, the Miami District Office of the EEOC filed this suit against Centennial Imports, Inc. in the U.S. District Court for the Northern District of Florida alleging discrimination on the basis of race in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant subjected the charging parties, five Black employees, to a racially hostile work environment comprised of unwelcome comments, racial slurs, offensive jokes, and the display of a hanging noose in the workplace by a supervisor. After some discovery, the defendant filed several partial motions for summary judgment in September 2003. All of these motions were denied in July 2004. In November 2004, the parties settled through a consent decree.

The four-year decree prohibited the defendant from discriminating or retaliating. It also required the defendant to: distribute its EEO policy to employees, provide Title VII training for its managers and supervisory personnel, post a Title VII notice, report to the EEOC on its compliance every six months, and pay $110,000.
