In August 2001 the El Paso, TX and San Antonio, TX offices of the EEOC brought this suit against TMBR/SHARP Drilling, Inc. in the U.S. District Court for the Western District of Texas. The complaint is unavailable, but documents indicate that the EEOC alleged racial harassment in violation of Title VII. The EEOC's suit charged TMBR with creating a racially hostile work environment for the African-American employee and four of his White co-workers because of their association with him. Five private plaintiffs intervened in the action. The case was settled and dismissed by both parties in October 2002. The exact details of the settlement agreement are unavailable; however documents indicate that the five private plaintiffs were awarded $859,000 to be divided equally.
