In January 2001, the EEOC district office in Denver, Colorado brought this suit against John Q. Hammons Hotels, LP (Holiday Inn-Northglenn), a national hotel franchise, in the U.S. District Court for the District of Colorado. Although the complaint is not available, the EEOC press release states that a deaf teenage female alleged that the defendant violated Title I of the Americans with Disabilities Act of 1990 (ADA) when it refused to hire her. Specifically, after showing that she was qualified for the job, she was told that the defendant did not hire people her age. However, during the litigation, it was shown that the defendant hired two non-disabled male teenagers, for the jobs that the aggrieved female was qualified for, soon after the incident. After failed defense motions for summary judgment and discovery, the parties settled. Although a consent decree was entered in February 2003, it is not available. Notwithstanding, the EEOC press release states that the aggrieved female received $75,000 in damages and that the defendant must provide EEO training.
