In April 2001, the Birmingham office of the EEOC brought this Title VII suit against Electronic Data Systems Corp. in the U.S. District Court for the Northern District of Alabama. The complaint alleged that the defendant discriminated against the complainant because of his sex. More specifically, the complainant requested that his work schedule be adjusted, as did a similarly situated female employee. The female employee's request was granted and the complainant was terminated. The defendant filed a motion for summary judgment in February 2002, and the court granted the motion in April 2002.The EEOC filed a notice of appeal in June 2002, and the Court of Appeals affirmed the district court's opinion in an unpublished opinion in January 2003.
