This case was brought by the EEOC's New Orleans district office in June 2005 against Kansas City Southern Railway Company, alleging that the defendant had violated Title VII of the Civil Rights Act of 1964 by disciplining and discharging African American employees due to their race or in retaliation for complaints about discrimination. In October 2005, a notice of relation was filed indicating that this case was related to a case one of the charging parties had filed against the same defendant. In November 2005, one charging party intervened and in March 2006 the charging party who had filed the private lawsuit intervened. Later that month, two more charging parties were denied leave to intervene. In July 2006, this case was consolidated with the case it to which it had previously been related (2:03-cv-02742-HGB-JCW). The private case became the lead case, and these consolidated cases have not been resolved as of April 22, 2008.
