In March 2005, the St. Louis District Office of the EEOC brought this suit against Midwest Racking Mfg., Inc., d/b/a Midwest Rack Mfg., Inc., in the U.S. District Court for the Southern District of Illinois. The complaint alleged that the defendant violated Title VII of the Civil Rights Act of 1964 by subjecting the charging party, a Black employee, to harassment and terminating him because of his race and in retaliation for his complaints of the harassment. The EEOC filed a motion for default judgment in late June 2005 which was granted a few months later in September. The default judgment required the defendant to pay the charging party $33,893.27 and to report to the EEOC within fifteen days of receiving a complaint of racial harassment or retaliation for a term of three years. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
