Case Summary

In August 1997, the EEOC's Cleveland office filed this suit in the U.S. District Court for the Northern District of Ohio against Ameritech Services, Inc., alleging violations of Title VII of the Civil Rights Act of 1964, the Equal Pay Act and the Fair Labor Standards Act. Several local union organizations were named as defendants as well because they were members of a collective bargaining agreement. The EEOC alleged that the principal defendant had unlawfully discriminated against female emp…

In August 1997, the EEOC's Cleveland office filed this suit in the U.S. District Court for the Northern District of Ohio against Ameritech Services, Inc., alleging violations of Title VII of the Civil Rights Act of 1964, the Equal Pay Act and the Fair Labor Standards Act. Several local union organizations were named as defendants as well because they were members of a collective bargaining agreement. The EEOC alleged that the principal defendant had unlawfully discriminated against female employees when it instituted a Pension Plan Enhancement Program that failed to give work-time credit to women when absent on maternity leave, thus failing to provide them with certain pension benefits. The defendant failed in its motion to transfer venue in September 1998 and withdrew its own motion to dismiss in February 2001. In May 2001 the defendant filed for summary judgment, which was followed by a cross-motion for summary judgment by the EEOC on July 2001. In February 2004, the court ruled on both and the defendant prevailed. The EEOC appealed the case to the Sixth Circuit Court of Appeals in April 2004. The appellate court, however, affirmed the judgment the following month.
