In July 2003, the EEOC's San Antonio office filed this suit in the U.S. District Court for the Western District of Texas against Invest America Management, Inc., alleging that the defendant had violated Title VII of the Civil Rights Act of 1964 when it unlawfully discharged a woman because of her race, which was Black. The woman intervened in the suit in October 2003 and added a Texas state law claim on top of the Title VII claim. The defendant had been properly served in September 2003, but did not make any other appearances in the case. As a result, the EEOC moved for and was granted a default judgment against the defendant in December 2003 and the complainant moved for and was given the same in March 2004. The EEOC's judgment awarded $422,932.65 to the complainant and enjoined the defendant from discriminating in the future as well as required the defendant to provide Title VII training to its managers and allow EEOC inspectors unfettered access to its facilities. The complainant was awarded $1,500,000 based on her intervening complaint.
