The Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois, against United Blood Services and Blood System, Inc. which together make up United Blood, a national firm in the business of collecting blood from donors and providing it to hospitals. The Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois, against United Blood Services and Blood System, Inc. which together make up United Blood, a national firm in the business of collecting blood from donors and providing it to hospitals. The complaint, filed in March 1999, alleged disability discrimination in violation of the Americans with Disabilities Act of 1990 (ADA); specifically that Defendant's medical leave policy illegally required termination of a class of employees with disabilities after 120 days without consideration of whether an extension would be a reasonable accommodation.

In July 1999, Defendant filed for summary judgment, but the motion was denied in December 1999. In January 2001 the EEOC filed for summary judgment, but the motion was denied in May 2001. The parties entered into a consent decree in August 2001. The decree, which was valid for one year, required Defendant to pay a total of $650,000 to 23 class members and restore the original hire date for some of the charging parties. Defendant was enjoined from violating the ADA in the future and required to provide ADA training for its managers, post a notice of anti-discrimination at its facility, adopt and implement a leave of absence policy, and regularly report to the EEOC about its compliance with the decree.
