In August 2001 the Houston District Office of the EEOC filed this lawsuit against D&S Residential Services Inc. in the U.S. District Court for the Southern District of Texas alleging discrimination on the basis of sex, female, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant terminated the two complainants, female employees, due to their pregnancies. Following some court scheduling, the parties settled the lawsuit in November 2002 through a consent decree.

The three year decree required the defendant to: report all pregnant employees terminated or placed on leave to the EEOC, post notice of employee rights, provide and certify provision of annual training regarding Title VII and pregnancy discrimination, and pay $44,000 to be distributed among two individuals.
