In July 2002, the Chicago office of the EEOC brought this ADA suit against United Air Lines, Inc. in the U.S. District Court for the Northern District of Illinois. The complaint alleged that the defendant discriminated against the claimant and others similarly situated by failing to hire them because of their physical disability. In July 2002, the Chicago office of the EEOC brought this ADA suit against United Air Lines, Inc. in the U.S. District Court for the Northern District of Illinois. The complaint alleged that the defendant discriminated against the claimant and others similarly situated by failing to hire them because of their physical disability. The case settled by entry of a consent decree in April 2004.

The two year consent decree required the defendant to refrain from discrimination, pay the claimants $750,000 (in the form of an unsecured claim against United, who was in bankruptcy proceedings), offer the claimants four domestic traveling vouchers, give the claimant's applications priority, post notice, keep all records concerning implementation and complaints of disability discrimination or failure to reasonably accommodate, give the EEOC reports every six months on compliance and complaints of disability discrimination, distribute its policy against disability discrimination, and provide ADA training for all managers and supervisors and medical personnel who perform pre-employment medical exams.
