MINUTES OF In Chambers before Judge Carolyn Turchin: Tape #: na. The magistrate judge is in receipt of plaintiff's [proposed] order and joint stipulation to vacate 3/8/04 date for third parties to comply with defendant's subpoena and to extend the date for compliance. The motion is DENIED. The joint stipulation proposes filing a discovery motion prior to the proposed agreed upon extended time for compliance. Such a motion would be a waste of the litigants' and court's resources since at the time the litigants' proposed filing the motion, they will not know whether there will have been satisfactory compliance with the subpoenas at issue. While the litigants to this dispute may agree among themselves to extend the due date for compliance with the subpoenas, any post-compliance dispute must be brought to the attention of the magistrate judge pursuant to the procedures outlined in Local Rule 37. The litigants to this dispute should not anticipate that the court will be able to shorten time. The court appreciates the litigants' attempt to resolve this dispute without the need for court intervention and encourages them to continue in this attempt.(dam, ) (Entered: 03/04/2004)
