In June 2001, the Seattle office of the EEOC brought this Title VII suit against Washington Energy Services Company and Blue Dot Services Company of Washington in the U.S. District Court for the Western District of Washington. The complaint alleged that the defendant discriminated against the defendant by subjecting him to harassment because of his race (black) and sex (male) and discharged him in retaliation for his complaint of discrimination. The claimant intervened in the EEOC's suit in September 2001. The case settled by entry of a consent decree in January 2001 (claimant also dismissed his suit on the same day).

The two year consent decree required the defendant to pay the claimant $75,000, refrain from discrimination, institute and carry out an anti-discrimination policy, provide employment discrimination training (two hours) for all managers, supervisors, and non-management employees, post notice, and give reports every six months to the EEOC pertaining to complaints of discrimination (sex or race) and compliance with the decree.
