In June 2006, the New York District Office and Washington DC Office of the EEOC filed this lawsuit against manufacturer Halo Sheet Metal, Inc. in the U.S. District Court for the District of New Jersey, alleging discrimination and retaliation on the basis of race, African-American. Specifically, the complaint alleged the defendant fired the complaining parties based upon their complaints that African-Americans were not being promoted and were being given work inferior to their level of seniority. Following some discovery, the parties settled the lawsuit in July 2007 through a consent decree.
The three-year decree, containing anti-discrimination and retaliation language, required the defendant to: report on complaints and make other compliance reports, allow the EEOC access for monitoring, develop an anti-discrimination policy, post and distribute notice of employee rights, provide EEO training, implement a complaint/dispute resolution process, and pay $70,000 to two individuals and their attorney. The docket sheet does not show any further enforcement; the case was presumably closed in 2010.
