Case Summary

The Detroit field office of the EEOC brought this suit against Michigan Seamless Tube in September 2005. The Detroit field office of the EEOC brought this suit against Michigan Seamless Tube in September 2005. The complaint alleged that seven African American complainants and similarly situated persons applied for employment and were not hired because of their race. Both parties submitted motions to compel discovery, and both were granted in part and denied in part. A successful settlement conference was held in February 2007, and a consent decree was entered into in June 2007.

The three-year consent decree established a $500,000 fund for disbursing awards to the complainants and similarly situated persons. The class members were required to sign a release in order to obtain their award; class members who could not be located or would not sign the release would have their awards divided equally among class members who had signed the release. The Defendant was required to comply with Title VI, to not discriminate or retaliate, and to actively advertise and recruit African Americans. The Defendant was required to train all of its employees on Title VII. Finally, the Defendant was also required to post a notice informing employees of their rights under Title VII.

The only additional activity that appears in the docket is approval of the settlement distribution process and proposed notice of distribution, as well as a notice of withdrawal of counsel. As there is no further enforcement activity, presumably the matter ended in June 2010.
