In September 2005, the Memphis and Little Rock Offices of the EEOC filed this lawsuit against Tobacco Superstores Inc. in the U.S. District Court for the Eastern District of Arkansas alleging discrimination on the basis of race, African-American, in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged the defendant failed to promote the complaining party and other African-Americans to managerial positions, causing the constructive discharge of the complaining party. The lawsuit had not been resolved as of its collection date on April 22, 2008. At the time of its collection, the parties were providing the District Court with memoranda regarding the defendant's motions for partial summary judgment, the last being March 24, 2008.
