In November 2002, the Los Angeles District Office of the EEOC filed this complaint against Mirage Casino-Hotel in the U.S. District Court for the District of Nevada alleging discrimination on the basis of race in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complain alleged that the defendant discriminated against the complainants, African-American and Hispanic job applicants, by refusing them employment and by retaliating against one of the complainants employed as a security guard for his opposition of the practice. The lawsuit was filed simultaneously with a settlement agreement between the two parties and was dismissed in January 2003.

The three-years settlement agreement required the defendant to: submit annual EEO-1 reports, submit semi-annual compliance reports, keep records of job applications, permit EEOC monitoring, appoint a claims administrator to oversee distribution of the class member settlement, provide annual EEO training to supervisors and managers, provide proof of an internal complaint procedure for reporting and investigating claims, and pay $1.14 million dollars to be distributed among class members and complainants.
