In September 2006, the EEOC's Philadelphia District Office filed suit against the restaurant chain Denny's. The complaint, which was filed in U.S. District Court for the District of Maryland, alleged that Denny's violated the Americans with Disabilities Act by refusing to allow a disabled employee to continue working there, and by refusing to make exceptions to its policy placing a cap on medical leave time.

In April of 2008, the case was stayed pending the outcome of settlement negotiations. As of April 22, 2008, no settlement had been reached and the case was still ongoing.
