In September 2005, the EEOC district office in Memphis, Tennessee brought this suit against SCI Tennessee Funeral Services, Inc., doing business as the Memphis Funeral Home and Family Funeral Care, in the U.S. District Court for the Western District of Tennessee. The complaint states that two female and two male former employees alleged that the defendant violated Title VII of the Civil Rights Act of 1964, based on sex discrimination, when it discharged the parties for complaining of the sexual harassment tolerated by female employees. While two defense motions for summary judgment were pending, the judge administratively closed the case. Upon it reopening, the parties settled and a consent decree was entered in March 2007.

In the consent decree, the defendant agreed to pay the complainants $150,000, provide a female complainant with a COBRA Continuation Offer, issue neutral references, follow its reference procedures, provide all its employees with EEO training, to comply with its existing harassment policy, post a notice of the consent decree, and submit semiannual complaint reports to the EEOC. No fees or costs were awarded. The terms of the decree ran for one year.
