In December 2002, the Newark Office of the EEOC filed this complaint against Toyota Logistics Services, Inc. in the U.S. District Court for the District of New Jersey alleging discrimination on the basis of sex and race in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the EEOC's Press Release that the complaint alleged that the defendant discriminated against the charging party by unlawfully deterring interested females and African-Americans from applying for drivers and auto accessories installers at its Port Newark facility. The parties settled the case shortly after it was filed in April 2000. We do not have a copy of the consent decree; therefore, the exact details of the settlement are unknown. However, it appears from the EEOC's Press Release that the defendant was required to: pay monetary relief to the complainant, contact welfare-to-work program applicants regarding job openings, provide additional EEOC training for all employees involved in recruitment and institute a Zero Tolerance program regarding discrimination and use ability to hand equal opportunity issues as one evaluation criterion for managers.
