EEOC's Atlanta, GA office filed this ADEA lawsuit against the defendant New England Life Insurance Co. at the United States District Court for the Southern District of Georgia (Savannah) on 12/18/1998. EEOC complained that the defendant adopted a mandatory retirement policy at its Savannah facility which forced employees to retire or refused to hire individuals after they passed 65 years old. The individual complainant passed 65 and was terminated. He did not intervene in the lawsuit or file a separate suit.

EEOC initially got the defendant's name wrong but corrected in an amended complaint. The docket did not provide much useful information regarding the parties' interplay during the litigation process. The only useful information is that a proposed consent decree was filed on 09/30/1999 and was approved on 10/04/1999.

The consent decree lasted for 1 year. The defendant agreed to pay the individual complainant $10,000. The defendant also agreed to clarify that its 65-year-old retirement policy was not mandatory. The defendant would do that by posting notices and distributing the clarification to all managing partners.
