In August 2004, the Little Rock Area Office of the EEOC brought this suit against Cross Gate Services, Inc. in the U.S. District Court for the Western District of Tennessee. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the consent decree that the complaint alleged that the defendant sexually harassed female employees, in violation of Title VII of the Civil Rights Act of 1964. After some scheduling orders, the parties settled in November 2005 through a consent decree.
The three-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: provide Title VII training for its employees, report to the EEOC at specified intervals, distribute its sexual harassment policy, post a notice of the decree, expunge the charging parties' personnel records of any references to the charges of discrimination, provide the charging parties with neutral employment references, and pay $45,000. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
