The Detroit District Office of the EEOC brought this action in the U.S. District Court for the Eastern District of Michigan, against Victory Lane. The complaint, filed in May 2004, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant subjected the charging party to a sexually hostile work environment. The parties entered into a consent decree in January 2005.

The decree, valid for two years, required Defendant to pay the charging party a total of $7,500 and provide Title VII training to its managers and supervisors. Defendant was enjoined from discriminating or retaliating in violation of Title VII and required to post a notice of non-discrimination at its facility.
