Case Summary

The New York District Office brought this action in the Eastern District of New York against John Harvard's New House, LLC., a restaurant and brewery business operating in nine states. The complaint, filed in August 2005, alleged sex and pregnancy discrimination in violation of Title VII of the Civil Rights Act of 1964, specifically that Defendant had taken adverse employment actions against the charging party because of her pregnancy. The parties entered into a consent decree in June 2004 which provided for Defendant to pay the charging party a total of $145,000. Defendant was required to provide the charging party with a neutral employment reference and provide Title VII training to its employees. Defendant was also enjoined from discriminating or retaliating in violation of Title VII, and the decree is in effect for three years.

The decree was entered in 2004 and scheduled to last 2007. No further docket entries exist, so the case is closed.

LETTER dated 4/27/04 from Kam Wong to Judge Spatt Re: In response to the Court's Notice regarding why an order should not be entered dismissing EEOC's action against John Harvard's Brew House. On 12/22/03, the parties agreed on the terms of a Consent Decree to submit to the Court for approval. The only outstanding issue has been dft's need to identify an appropriate anti-discrimination on-line training for EEOC's review and approval, which will then be incorporated into the terms of the Decree. EEOC requests that the Court not dismiss its Complaint, and that a telephonic conference with either your Honor of Magistrate Judge Wall be set in two weeks time regarding finalization of this training issue.
