The EEOC Chicago office filed this suit on September 5, 2002 in the U.S. District Court for the Northern District of Illinois, Chicago Division. After filing, the court held four status conferences. On April 2, 2003 the case was referred to a settlement conference. That conference, at which the parties reached an agreement, occurred on July 18, 2003. On August 28, 2003 the consent decree was filed with the court. It was entered by the court on September 2, 2003.

The defendant agreed to pay the complainant $149,999 . Beyond monetary relief, the defendant agreed to very little in the consent decree. The only injunctive relief in the decree was an agreement to provide the complainant a reference letter and not to challenge his bid for unemployment benefits.
