In 1992, Florida inmates filed a class-action lawsuit under the Americans with Disabilities Act, alleging that they were denied the maximum amount of incentive gain time at Holmes Correctional Institution because they were disabled. Inmates could earn incentive gain time only through security, work and program components, which proved problematic for inmates not able to perform work due to disability. The inmates were represented by the Florida Justice Institute. On March 21, 1997, the U.S. District Court for the Northern District of Florida (Magistrate Judge William C. Sherill, Jr.) held that the prison's regulation making disabled prisoners ineligible to receive maximum amount of incentive gain time discriminated against prisoners with disabilities in violation of the ADA, but found that it did not constitute cruel and unusual punishment in violation of the 8th Amendment. The court also held that the ADA did apply to state prisons. Raines v. Florida, 963 F.Supp. 1362 (N.D.Fla. 1997).

The parties negotiated a proposed settlement that provided a number of major changes in the way incentive gain time was awarded in Florida. Following a fairness hearing on the proposed agreement, the court approved the settlement on November 21, 1997. Raines v. Florida, 987 F.Supp. 1416 (N.D.Fla. 1997) (Judge Sherrill)

Following a status report, Judge Sherill dismissed the case on March 31, 1998. Inmates' motion to to reopen the case after the Supreme Court's decision in Pennsylvania v. Yeskey, 524 US 206 (1998) (applying the ADA to prisons) was denied by Judge Sherill on August 7, 2000. A subsequent motion by a non-party to reopen the case in 2002 was also rejected.
