The Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois, against Jetson Midwest Mailers, Inc. The complaint, filed in March 2001, alleged discrimination in violation of the Americans with Disabilities Act of 1990 (ADA); specifically that Defendant had wrongfully terminated the charging party because it had perceived her to have a disability.

The parties entered into a consent decree in December 2001. The decree was valid for two years and required Defendant to pay the charging party $32,500. Defendant enjoined from discriminating or retaliating in violation of the ADA and was required to post a notice of non-discrimination at its facility, provide ADA training to its managers and human resource personnel, and report regularly to the EEOC about its compliance with the decree.
