The Memphis District Office of the EEOC brought this suit against Tri-State Security, Inc., which provides security services for various companies in Chattanooga, Tennessee, in July of 2004, in the U.S. District Court for the Eastern District of Tennessee. The case was based on discrimination of a handicapped person, in violation of the Americans with Disabilities Act. The complainant, who intervened in the suit, was a male who was hit by a car as a child and suffered brain damage and was susceptible to seizures. He was hired to be a security guard by the defendants and then was terminated upon the defendants learning he needed medication for seizures. The suit was resolved by a consent decree in January of 2005.
The consent decree contained both monetary and injunctive relief. The defendant was to pay the complainant $30,000. The injunctive relief consisted of two hours of training about harassment under the American's With Disabilities Act. In addition they were to place notice of the suit in their facility. The settlement term was 3 years. The docket sheet does not show any further enforcement; the case was presumably closed in 2008.
