The Los Angeles District Office of the EEOC brought this action in the U.S. District Court for the Central District of California, against Valley Temps, Inc. The complaint, filed in April 2000, alleged national origin discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that Defendant discharged charging party because of her national origin, Guatemalan.

The parties entered into a consent decree in February 2001. The decree, valid for two years, required Defendant to pay the charging party a total of $12,000, and to expunge her employment records. Defendant was enjoined from discriminating or retaliating in violation of Title VII, and required to provide Title VII training to the manager responsible for the conduct in this case, and report regularly to the EEOC about its compliance with the decree.
