In September 2001, the EEOC district office in Pittsburgh, Pennsylvania brought this action against the Charleston Area Medical Center, a general health care facility, in the U.S. District Court for the Southern District of West Virginia. The complaint states that a Black female former employee alleged that the defendant violated Title VII of the Civil Rights Act of 1964 when it terminated her employment under the guise of a reduction in force layoff. Specifically, the complainant alleged that she was the only Black person working at the facility and she was told that all persons in her department were slated for layoff, but she was the only one laid off. After some discovery, the parties settled and a consent decree was entered in September 2002.

In the consent decree, the parties agreed that the defendant would pay the aggrieved female $45,000, refrain from retaliating and discriminating on the basis of race, post an EEO notice, and maintain its current practice of providing EEO training to its staff. No fees or costs were awarded. The terms of the agreement ran for one year.
