EEOC's Baltimore, MD office filed this Title VII sexual harassment lawsuit against the defendant KFC U.S. Properties, Inc. dba KFC on 09/30/2003. The lawsuit was filed at the United States District Court for the District of Maryland (Greenbelt). EEOC alleged on behalf of a former female employee that she was subject to a sexually hostile work environment and that she was wrongfully terminated for opposing the practice. The individual complainant intervened in the lawsuit.
EEOC initially listed YUM! Brands, Inc. as the defendant and corrected it to KFC US in an amended complaint. Soon after that the parties reached a settlement agreement. A consent decree was entered into the judgment on 07/19/2004.
Under the two-year consent decree, the defendant agreed to pay the individual complainant $25,000 as back pay and compensatory damages. The defendant was also required to hold an hour training for all employees at the specific store and report sexual harassment complaints to the EEOC every 90 days.
