In January 2001, the St. Louis District Office of the EEOC (with participation from the Kansas City Area Office) brought this suit against The Jones Store Company, which was acquired by May Department Stores, Inc., in the U.S. District Court for the Western District of Missouri alleging discrimination in violation of the Age Discrimination in Employment Act. Specifically, the complaint alleged that the defendant failed to assign the charging party, an employee of 59 years of age, to the Estee Lauder cosmetics counter because of her age, resulting in lower commissions and earnings for the charging party. The parties settled almost immediately, filing a motion to voluntarily dismiss the case on the same day that the complaint was filed. They settled through a settlement agreement in January 2001.
The settlement agreement contained non-discrimination and non-retaliation clauses and required the defendant to: post an EEOC notice, provide the charging party with a positive employment reference, and pay the charging party $6,000.
