Case Summary

In September 2001, the EEOC district office in Dallas, Texas brought this suit against the Joe Brown Company in the U.S. District Court for the Western District of Oklahoma, alleging that the defendant violated Title VII of the Civil Rights Act of 1964 when it subjected a black employee to a racially hostile work environment and terminated him in retaliation for complaining about it.

The case was settled and a consent decree was entered in June of 2002. The parties agreed that the defendant would pay the complainant $25,000, refrain from retaliating and discriminating on the basis of race, post an EEO notice, distribute its EEO policy, provide all of its employees with EEO training, file quarterly race statistical reports, file semiannual complaint reports, expunge the complainants employee file, and issue a neutral reference letter. No fees or costs were awarded. The terms of the agreement ran for eighteen months.
