The Philadelphia District Office of the EEOC brought this action in the U.S. District Court for the Eastern District of Pennsylvania, against Resources for Human Development. The complaint, filed in September 2002, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964; specifically that charging party had been subjected to sexual harassment, including frequent sexual advances and derogatory remarks, retaliation and constructive discharge.

In March 2004 the parties entered a consent decree which was valid for 2 years. The decree prohibited Defendant from discriminating or retaliating in violation of Title VII and required Defendant to pay charging party a total of $90,000 ($87,000 in compensatory damages and $3,000 in backpay). Defendant was also required to post and distribute a notice of non-discrimination at its facility; provide annual anti-discrimination and anti-harassment training to its managers and supervisors; draft a non-discrimination policy in English and Spanish that includes a complaint procedure designed to encourage employees to come forward with complaints regarding violations of its policy; and regularly report to the EEOC about its compliance with the decree.
