In June 1998, the EEOC district office in Dallas, Texas brought this suit against the Horn Seed Company in the U.S. District Court for the Western District of Oklahoma. Although the complaint is not currently available, the consent decree states that a female employee alleged that the defendant maintained a sexually hostile work environment in violation of Title VII of the Civil Rights Act of 1964. After the employee intervened and filed her complaint, the parties settled and a consent decree was entered in August 1998.
In the consent decree, the parties agreed that the defendant would refrain from retaliating or discriminating on the basis of sex, implement and distribute its EEO policy, post an EEO notice, provide EEO training, issue a neutral reference letter, expunge its employment records, issue a written reprimand to the offender and place it in his employee file, and pay the aggrieved party $40,000. No fees or costs were awarded. The terms of the agreement ran for three years.
