In August 2003, the Detroit District Office of the EEOC brought this suit against Acro Service Corporation in the U.S. District Court for the Eastern District of Michigan alleging discrimination on the basis of sex and pregnancy in violation of Title VII of the Civil Rights Act of 1964. Specifically, the defendant's manager made offensive remarks about pregnant women. When the charging party, a pregnant employee, complained of the remarks, she was laid off. In addition, the defendant failed to rehire the charging party for other open positions for which she was qualified because of her pregnancy and her complaints of discrimination, hiring two males for those jobs instead. After a single scheduling order, the parties settled in June 2004 through a consent decree.
The two-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: provide EEO training for all its managers and supervisors in its corporate office, post a notice of the decree, and pay $35,000 to the charging party.
