In June 1998, the EEOC district office in Miami, Florida brought this suit against the Kanon Service Corporation in the U.S. District Court for the Southern District of Florida; in late September, the case was transferred, at the EEOC's request, to the Middle District of Florida. The complaint alleged that the defendant violated Title VII of the Civil Rights Act of 1964 when it terminated an employee who, as a Seventh Day Adventist, refused to work on Saturday.

In December of 1999 the case was settled and a consent decree was entered. The parties agreed that the defendant would refrain from discriminating on the basis of religion, provide EEO training for all its supervisors, post an EEO notice, provide neutral reference letters, retain all employee records, provide a copy of the consent decree to any employee who wishes to see it, and pay the aggrieved party $15,282 in back pay.
