The Detroit Office of the EEOC brought this action in the U.S. District Court for the Eastern District of Michigan, against Donnkenny, Incorporated. The complaint, filed in September 1997, alleged age discrimination in violation of the Age Discrimination in Employment Act. Specifically, the complaint alleged that Defendant had failed to hire the charging party because of his age and then retaliated against him for filing a complaint with the EEOC.
A consent decree was entered in June 1998, which provided for Defendant to pay the charging party $60,000. The decree also contained non-discrimination and non-retaliation provisions as well as required Defendant to hold a one-time Title VII training and post a non-discrimination notice.
