The EEOC's New York district office sued Teamsters Local 804 on March 26, 2004 in the U.S. District Court for the Southern District of New York. The EEOC's complaint alleged that the union violated the Americans with Disabilities Act when it divulged to the complainant's co-workers that the complainant had a physical disability (AIDS). The union filed a motion for summary judgment against the EEOC in January 2006, which was denied in April. Ultimately, the parties entered into a settlement agreement on October 23, 2006 which stipulated that the defendant would pay the complainant $20,000 in damages, aid the complainant's transfer to another UPS branch, post a notice of compliance with the ADA, and provide 2.5 hours of ADA training.
