First Student, Inc., part of First America Group, Inc., a transportation services provider, is a private contractor that transports more than 1 million students for more than 500 school systems nationwide. EEOC alleged on behalf of a black employee at the defendant's Canton, MS facility that he was subject to less pay for performing the same work as a similarly situated white employee. The employee did not intervene the lawsuit.

The lawsuit was resolved on 1/31/2007 with a 3-year consent decree. The 3-item docket does not record any procedural events that took place before the entry of the decree.

Under the decree, the defendant was required to pay the employee $20,224.00 in back pay. It was also required to provide neutral reference for the employee. Additionally, the defendant was prohibited from racial discrimination or retaliation. The defendant was required to provide annual training for all of its employees in Mississippi, post notices about its revised EEO policies and the settlement of this lawsuit. The defendant also agreed to distribute its EEO policies and report to the EEOC about compliance with the above non-monetary obligations. The docket sheet does not show any further enforcement; the case was presumably closed in 2010.
