In May 2005, the Phoneix District Office and Albuquerque and Denver Offices of the EEOC filed this lawsuit against Walgreen Company, doing business as Walgreen Arizona Drug Company in the U.S. District Court for the District of Arizona alleging discrimination on the basis of gender, female, in violation of Title VII of the Civil Rights Act of 1964 and Equal Pay Act. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the Opinion and Order that the defendant allegedly failed to promote the complaining party to a managerial position in two instances prior to her receiving the position. Following some discovery, the defendant successfully moved for summary judgment in March 2007. The EEOC appealed the decision to the U.S. Court of Appeals for the Ninth Circuit, which was voluntarily dismissed in January 2008. Costs of $ 8,160.15 were taxed against the EEOC.
